When Markoff asked him about the NTP patents, Goodfellow was scornful about the whole process and told the Times reporter, You don t patent the obvious The way you compete is to build something that is faster, better, cheaper You don t lock your ideas up in a patent and rest on your laurels 1

The co-owner of NTP, and originator of the patents, was Chicago engineer and inventor Thomas Campana Jr Like Mike Lazaridis, Campana had a passion for all things electronic, xing transistor radios, and building stereos and TV sets from kits At age twentyfour, he started his own contract engineering company, Electronic Services Associates, later ESA Telecom Systems One of his rst patents, developed with a young Virginia lawyer named Donald Stout, was a national paging system that could be used on different frequencies using radio waves Donald Stout had spent four years as an examiner in the US Patent and Trademark Of ce Once he learned the ins and outs of the system, he left the USPTO and opened his own patent practice across the Potomac In 1985, Stout joined Campana and others in starting a new marketing company called Tele nd Corp in Coral Gables, Florida ESA was folded into Tele nd as its engineering arm, and Campana and crew worked on building a better paging system In 1987, ve years after Geoff Goodfellow s RadioMail, ESA brought out a primitive form of wireless e-mail that could send 500-character messages from computers to pagerlike devices, but it was not a two-way system and they could not transmit messages back Two employees of ESA, Michael Ponschke and Gary Thelen, wrote the software

In 1990, Campana s work in wireless e-mail caught the eye of AT&T executive Murali Narayanan, who signed up Tele nd to help build a system to send e-mails to the telco s experimental Safari laptop computer via a wireless paging system He described Campana as an absolute entrepreneur a kid at heart Tele nd pulled together a working demo at AT&T headquarters in New Jersey on October 26, and AT&T showed it off at the huge Comdex show in Las Vegas But there wasn t much interest, and the system didn t yet work very well Narayanan then decided to drop Tele nd and keep looking He later hooked up AT&T with a larger wireless partner Skytel Donald Stout and Thomas Campana were devastated by the loss of the AT&T account, which put Tele nd over the edge into bankruptcy Campana was left with debts of nearly $500,000 and the rights to much of Tele nd s paging technology, which nobody wanted So he and Stout took stock and decided they might as well salvage some of the work ESA had done, plus some new ideas Ponschke and Thelen were developing, and le for patents The pair worked hard pulling the documents, claims, and technical drawings together and, on May 20, 1991, led a patent application for a method to merge existing e-mail systems with radio-frequency (RF) wireless networks It was titled Electronic mail system with RF communications to mobile processors and method of operation thereof The method showed a system to receive e-mail outside the of ce without needing a computer connected to a landline The patent of ce granted Campana the rst patent #5,436,960 on July 25, 1995, and four others: #5,625,670, #5,819,172, #6,067,451, and #6,317,592, each with a similar title; they are considered continuations of the rst The Campana patents were quite bulky, with from 62 to 665 claims each, and they were densely interrelated

Campana s patents described a system where a message originating in an electronic mail system may be transmitted not only by wireline but also via RF, in which case it is received by the user and stored on his or her mobile RF receiver The user can view the message on the RF receiver and, at some later point, connect the RF receiver to a xed destination processor, ie, his or her personal desktop computer, and transfer the stored message Murali Narayanan, who later ended up testifying on behalf of RIM, was surprised Campana got the patents in the rst place As a computer guy, putting e-mail and paging together seemed obvious to me However, many early patents only seem obvious after the fact But to the USPTO in 1991, the Campana patents hardly seemed obvious, as very few people were in the eld of wireless e-mail For Stout, the important thing was to le In 1992, he and Campana decided to partner in a new virtual company, NTP Inc, to patent and license more of Campana s inventions and methods and sit on the e-mail patents until the market warmed to the technology Stout was able to attract twenty-two investors to cover litigation expenses Most were former Tele nd shareholders who had just seen the company go under One of Campana s fty patents was for a wireless locater technology that helped parents nd their kids within a one-mile radius his wireless child nder won rst prize at the 1996 Consumer Electronics Show

The idea with emerging patent holding companies such as NTP the so-called patent trolls was to focus their license demands on the smallest companies in a sector and overwhelm them with claims Some of Campana s individual patents were quite elaborate
